Safegaurding Your Plans
Identifying people who can and will take on significant roles in one’s estate plan is often the
most difficult part of the planning process.
Assuming that other adult children or other family
members will automatically “step-in” upon the parent’s incapacity or death is unwise and unrealistic.
Asking people to take on the following roles will most likely be required to put a plan into place:
Executor or Executrix and Alternate(see Glossary)
Power of Attorney and Alternate (see Glossary)
Health Care Surrogate – go to

Putting a plan into place will require the assistance of an attorney whose area of expertise includes estate
planning, an understanding of public benefits (particularly SSI and Medicaid), guardianship, and special or
supplemental needs trusts. The following list is by no means exhaustive, but does represent attorneys in
